Radcliffe Chambers occupies a leading position in consumer credit law. Members of Chambers are instructed on a wide range of consumer credit issues, including unfair relationships claims. Their clients include banks, building societies and other financial institutions, the OFT, the FCA and individuals. They welcome instructions from in-house lawyers and legal departments, as well as from firms of solicitors.

For contentious work, our members provide advice, drafting and representation for proceedings in courts and (in licensing matters) for hearings before OFT adjudicators, the First Tier Tribunal and the Upper Tribunal. We also provide advice and representation in mediations and other forms of alternative dispute resolution. We have experience in preparing written representations to the Financial Ombudsman Service in cases with wider implications.

For non-contentious and transactional work, members can provide advice and drafting for all forms of consumer credit transactions.

Members of Chambers have considerable expertise in the law relating to mortgages and security. They are, therefore, well equipped to act in matters where a credit agreement is, or is to be, secured by a land mortgage or other form of security.

Consumer credit work often involves consideration of other consumer protection regimes, such as the Unfair Terms in Consumer Contracts Regulations 1999, the Consumer Protection from Unfair Trading Regulations 2008 and mortgage regulation. Our members have additional expertise in these areas.
